Testimony for Hearing of the Senate Committee on Economic Development
Dear Honorable Member of this Committees
You have come together to study legislative and regulatory barriers that could impede capital investment, growth, and expansion of Texas Businesses. I invite you to visit these websites and there you will find the greatest barriers, both legislative and regulatory.
Nothing will scare away capital investment and business expansion more quickly and completely than an absence of Liberty, also known as the Rule of Law, and Justice, also known as Restitution for the victim of a wrong by government. The well documented experience of a business owner who lost his capital investment in our Texas in our County of Harris, City of Houston, will deter capital investment and encourage business to leave Texas as soon as they can.
The experience reveals a regulatory scheme in Texas that is without any boundaries of the law. Your laws, regulating the relationship between a Real Estate Broker and Real Estate Agent, can be ignored by State Actors, known as prosecutors. Lawful Contracts approved and promulgated by the State regulatory agency known as the Texas Real Estate Commission, can be ignored, by State Actors known as prosecutors.
The Contractual relationships created pursuant to the regulations you, our Honorable Legislators have created, can be interfered with, destroyed, and obligations impaired in violation of the protection of the sanctity of contracts (also known as private law) our US and Texas Constitutions intended to secure.
People know that mistakes happen. Even those employed by the government (aka 'the State') as Prosecutors and Judicial Officials, can error. Awareness of these may only cause some deterrence to deter capital investment or have a minor influence on business migration in or out of our Texas. But what will surely stop all inflow of capital investment and lead to business flight is awareness that our Legislature refuses to provide restitution to the business owners who are the victim of State Actors who, as Prosecutors and Judicial Officials, subject business owners to ex post facto, unlimited, regulations that are not legislative but of their own creation.
The victims of the BP oil spill do not have to seek restitution from the errant employees of BP. Likewise, the victim of errant employees of the State are entitled to restitution from the State.
